The U.S. is a patchwork — what's legal in one state can be a felony 10 miles away. Here's how to read the map before you travel.

The short answer

There is no single U.S. cannabis law. Each state sets its own rules for possession limits, purchase amounts, public consumption, home growing, and medical access. As a traveler, you are bound by the law of the state you're standing in — not the one you flew in from.

The four legal categories

Recreational

Adult-use legal

21+ can purchase from licensed dispensaries. Includes CA, CO, NV, WA, OR, MI, IL, NY, NJ, MA and more.

Medical only

Patient card required

Out-of-state visitors usually cannot buy. Some states honor reciprocity for medical cards.

Decriminalized

Civil fine, not jail

Small possession amounts are not criminal, but you still can't legally buy or carry openly.

Fully illegal

Criminal possession

A handful of states still prosecute possession, including some southern states.

Why state lines matter

Crossing a state line is a federal act

Even between two legal states, transporting cannabis across the border violates federal law. Buy where you are, consume where you are, and leave the rest behind.

Possession & purchase limits

Most adult-use states cap personal possession at about 1 oz of flower, with separate limits for concentrates and edibles. Daily purchase limits vary — Colorado, Nevada, and California are roughly aligned, while New York and Massachusetts use different concentrate caps. Check the specific state before your trip.

Where you can actually consume

Buying is legal in many states; consuming in public is not. Hotels, rental cars, federal land (national parks, monuments, military bases), and most outdoor public spaces are off-limits. A handful of states license consumption lounges — Nevada and New Mexico lead here.
